Privacy Notice


Introduction

Netsmart Technologies, Inc. ("Netsmart", "we", "us", or "our") respects your privacy and is committed to protecting it through our compliance with this privacy notice ("Privacy Notice"). This Privacy Notice identifies the types of personal information we may obtain from or about you and our practices for collecting, using, maintaining, protecting, and disclosing that personal information for the sole purpose of providing CareRouter to our clients.

Applicability

This Privacy Notice applies to the CareRouter solution, and the services made available through it, including related software, mobile applications, websites, electronic health record systems, and other supporting platforms (collectively, "CareRouter", or the "Application"). This Privacy Notice applies to the personal information accessed, collected, used, and processed on behalf of agencies, organizations, providers and other entities who contract with Netsmart for CareRouter ("Clients"). This Privacy Notice also applies to agency personnel, administrators, caregivers, and other authorized users who use CareRouter through a Client.

Personal Information We Collect & the Purpose

Personal information is any information accessed, collected, or used by Netsmart or your agency that identifies an individual, or can reasonably be used to identify an individual, whether directly or indirectly ("Personal Information"). Upon your request or with your consent, your agency may share Personal Information about you with Netsmart to provision and maintain Services. When you use the CareRouter application, we may collect additional Personal Information about you to provide Services to your agency and improve your user experience with the application.

Category of Personal Information Business or Commercial Purpose(s) for Collection
Personal Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, email address, account name, or other similar identifiers. CareRouter collects personal identifiers for the purpose of user identification, authentication, auditing, authorization, and reporting. This information includes, but is not limited to, name, address, telephone and fax number, email address, account number.
Online Identifiers, which, when used in conjunction with a Personal Identifier, will identify a single user by associating information an individual leaves when operating online. This may include information relating to the device (such as a specific operating system), application, or protocol that an individual is using to access the application. The application collects online identifiers from users for the purpose of user identification, authentication, auditing, and monitoring.
Geolocation Information, which is information that can be used to identify an electronic device's physical location. CareRouter requests device GPS information and, if permitted, collects precise geolocation information when the CareRouter Application is in use to identify users who are closest to patients who request care. Precise geolocation is also collected when visits are accepted, started, and completed.
Individual Profile Information, which may include inferences drawn from any of the information identified to create a profile about a user reflecting their preferences, characteristics, psychological trends, preferences, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. CareRouter collects information from the user and their preferences to create an individual user profile.

How We Use Personal Information We Collect

We use Personal Information collected from CareRouter users to provide CareRouter pursuant to the contract with our Clients. We may use Personal Information to:

  • Provision services to enable the use of the CareRouter Application
  • Provide CareRouter to Clients and their authorized users
  • Respond to user service requests and administer user accounts
  • Perform diagnostic and troubleshooting
  • Conduct research and analysis
With regards to Personal Information shared by your agency, Netsmart will only use such information in accordance with any instructions or restrictions provided to Netsmart by the data controller or the covered entity, as defined in our services agreement.

How We Share Personal Information with Service Providers & Third Parties

We do not sell your Personal Information to third parties. We do not share your Personal Information with third parties for their promotional or marketing purposes. We may disclose Personal Information that we collect, as described in this Privacy Notice, with third parties who support our business (i.e., contractors, service providers, business partners, etc.) to:

  • Provide and support CareRouter to Clients and their authorized users.
  • Comply with legal requirements and corporate transactions.
  • Enforce applicable Terms of Service, including investigation of potential violations.
  • Detect, prevent, or otherwise address fraud, security, or technical issues.
  • Protect against harm to the rights, property, or safety of our users, Netsmart, or the public as required or permitted by law.
  • Engage in mergers, acquisition, reorganization, or sale of all of portion of Netsmart's assets.
  • Comply with any court order, law, or legal process, including responding to any government or regulatory request.
  • For any other purpose disclosed by us when you provide your Personal Information.

Protection of Your Personal Information

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. We use physical, electronic, and administrative safeguards to protect your Personal Information. The safety and security of your Personal Information also depend on you. Where we have given you (or where you have chosen) a password for access to the CareRouter Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Retention of Your Personal Information

Netsmart develops and hosts the CareRouter Application but processes information solely on behalf of Clients. Clients serve as the data controllers and determine how Personal Information is collected, used, retained, and deleted. Personal Information processed through CareRouter is retained in accordance with the applicable Client's retention policies, contractual requirements, and legal obligations. As a result, retention periods may vary depending on the Client and the type of information involved. Users who wish to request access to, correction of, or deletion of their Personal Information should contact the Client that provided them access to CareRouter. Netsmart does not, and cannot, independently determine whether Personal Information should be deleted. Upon receipt of a valid instruction from the applicable Client, Netsmart will delete or return Personal Information in accordance with its contractual obligations and applicable law.

Your Privacy Rights

As a service provider, Netsmart processes Personal Information on behalf of our Clients and has no control over Clients’ privacy and data security practices. Accordingly, Netsmart does not, and cannot, respond directly to requests to exercise privacy rights. Please direct your privacy rights requests to your agency administrator. Netsmart will support your agency in responding to such requests as required by applicable law and our contractual obligations.

Changes to our Privacy Notice

We reserve the right to amend this Privacy Notice at our discretion and at any time. When we make changes to this Privacy Notice, we will post the updated Privacy Notice on the CareRouter Application website and update the notice’s “Last Modified” date. You are responsible for regularly reviewing the terms of the Privacy Notice to stay informed of changes or modifications of the Privacy Notice.
